A vehicle leaving a roadside parking spot collides with a vehicle driving on the road.
In the diagram, Vehicle B is driving on the roadway. Vehicle A exits the parking spot onto the roadway as Vehicle B approaches and then collides with Vehicle A.

The rules of the road
Drivers leaving a parking spot on a roadway must ensure that it is safe to drive a vehicle that was parked, standing, or stopped. Therefore, the Vehicle A driver would be found 100% responsible.
