If you or any of your children are injured, you will need to apply to receive ICBC's no-fault Accident Benefits. These medical and disability benefits are available to nearly everyone in British Columbia who has been injured in a crash, either as a vehicle occupant, pedestrian or cyclist.

If you are the parent or guardian of a child who has been injured in a crash, be aware that injury settlements for individuals below the age of 19 must be reviewed by the Office of the Public Guardian and Trustee of British Columbia (OPGT)  at 604-660-4444.

• You meet with an adjuster. During the meeting, you provide a statement about the accident, and sign Accident Benefits and release-of-information forms. Learn more about meeting your adjuster »
• Your adjuster investigates your injury claim. There are certain obligations for both you and ICBC.
• There are many more considerations for your claim assessment. Your adjuster can provide specific information based on medical reports and contributing factors. Contributing factors include fault assessment, seat belt use, low-velocity impacts, soft-tissue injuries.
• You work with your doctor and other health-care professionals to help return to your pre-accident condition as soon as possible.
  

Be sure to mention to your adjuster that you cannot work. You may be entitled to additional benefits. Also, be sure to contact your local Employment Insurance (EI) office and find out what you should be doing to safeguard your EI claim for disability benefits.

You have 90 days after your accident to return your Accident Benefits form to ICBC or you may lose your right to claim for those benefits.

If you are injured in a motor vehicle crash, you can apply for ICBC Accident Benefits to help you with medical costs and wage loss, regardless of who is at fault.

Yes. Your adjuster will need to confirm your employment history for the previous 12 months. Please bring a recent pay slip to your first appointment. Also, make sure your adjuster knows if you are covered by a corporate disability insurance plan where you work—or any other disability plans. Talk to your adjuster for details.

If you are an employed person who is disabled in a crash, you may be eligible for up to 15 weeks of Employment Insurance sickness benefits.

If you claim ICBC wage loss benefits, you should apply for EI benefits immediately.

EI has a two-week waiting period before benefits begin. If you are disabled, ICBC benefits begin on the eighth day, and will cover you for the second week of the EI waiting period. For more information on sick benefits, visit HRSDC .

You must inform your adjuster about any other disability payments to which you might be entitled. Other disability payments payable to you will be deducted from your ICBC Accident Benefits wage loss payments.

If you are covered by WorkSafeBC insurance, you are entitled to benefits from the WorkSafeBC for lost income when you are unable to work because of a job-related injury.

Job-related injuries can include those suffered in a crash while you are working.

If you are eligible for WorkSafeBC benefits, you cannot also receive ICBC benefits—except for the portion of ICBC benefits exceeding the amount of the WorkSafeBC benefits.

If you are a homemaker who is substantially disabled in a crash and cannot perform most household tasks, you may receive up to $145 per week to hire a non-family member to perform household tasks on your behalf.

Benefits are available as long as the disability lasts, or until the disabled person reaches age 65, whichever comes first.

After the first 104 weeks of payment, you may be eligible to receive Canada or Quebec Pension Plan benefits. Your ICBC benefits will be reduced by any amounts received from the Canada or Quebec Pension Plans.

If you are involved in a crash and the other motorist is found to be at fault, that driver's Third Party Liability coverage under Basic Autoplan will pay for your compensable claim. For example, the at-fault motorist's insurance could pay for your vehicle repairs and rental car.

If you are injured, you may receive compensation for the following:

• medical treatment beyond the limits of Accident Benefits
• loss of earnings beyond the limits of Accident Benefits
• pain and suffering

Is your injury causing you financial hardship? If your case has still not been settled, your adjuster may consider providing you with advance payments for your net wage loss and other out-of-pocket expenses.

Advance payments can only be made after your adjuster has received confirmation of your medical condition and earnings.

Advance payments for net wage loss are only available if you are eligible to receive compensation from a motorist found at least partly at-fault for the crash in which you were injured.
